Within the scope of these General Terms and Conditions of Sale, the term “customer”, “consumer” or “user” refers to the purchasing party.
Unibrands Italia S.r.l. offers its products on the website www.fooditalian.nl through its e-commerce platform exclusively to customers/consumers, as defined under consumer law Article 3, paragraph 1, letter a), who are at least 18 (eighteen) years of age, and in compliance with e-commerce legislation. Purchases by persons under 18 (eighteen) years of age are strictly prohibited, and any order identified as such will not be processed.
By purchasing products on our site and confirming that they have read these General Terms and Conditions of Sale, the customer expressly declares that they agree to these Terms and Conditions, that they are over 18 (eighteen) years of age, and that they have understood these General Terms and Conditions, which constitute a binding agreement. These Terms and Conditions and all content on the website www.fooditalian.nl are drafted in the Italian language and refer primarily to Legislative Decree no. 206 of 6 September 2005, to regulations governing distance contracts, and to Legislative Decree no. 70 of 9 April 2003 on e-commerce.
The purpose of these General Terms and Conditions of Sale is to regulate the offering of products, their purchase by the customer, the right of withdrawal, and all other activities that take place on the platform www.fooditalian.nl.
The purchase contract for products offered on www.fooditalian.nl is concluded when the customer has completed the purchase forms, accepted the General Terms and Conditions of Sale, and submitted the form by clicking the send button. The customer will receive an order summary and a confirmation email accepting the order; the order is thereby considered accepted and will be processed.
Unibrands Italia S.r.l. also reserves the right to collect orders through alternative means such as telephone, chat, email, Facebook, Instagram, etc. Confirmation of having read these General Terms and Conditions may be given verbally or via such alternative means. The confirmation email with the order summary constitutes proof of order acknowledgement in all cases.
Unibrands Italia S.r.l. reserves the exclusive right to refuse and not process an order, without providing justification to the customer, while notifying the customer in writing. In the event that goods ordered by the customer are unavailable, even after the order has been accepted, Unibrands Italia S.r.l. has the right, subject to prior notice, not to process the order. If the customer has already made payment, Unibrands Italia S.r.l. will refund the amounts paid within no later than 7 working days.
The products offered on www.fooditalian.nl are all of high quality, the result of careful research and selection of suppliers operating in compliance with national and European food hygiene and food safety standards, subject to quality controls by Unibrands Italia S.r.l. through periodic audits at production facilities.
The information on product labels is prepared in compliance with the law and the accuracy of such information is guaranteed by the manufacturer, even where the labels themselves have been prepared by Unibrands Italia S.r.l. The information on the labels of products available for sale on the platform may vary for reasons beyond our control, and therefore there may be differences between the information on the website and the information on the delivered products. The customer is required to always check the information on the purchased product before consumption. Unibrands Italia S.r.l. accepts no liability for information stated on products, as this information is provided by the individual manufacturers.

All product prices on www.fooditalian.nl are inclusive of VAT in accordance with current legislation. The cost of transport, entrusted to external couriers, is stated separately and is visible at checkout prior to payment. Prices are updated periodically without prior notice. The prices displayed at the time of order are the current prices.
To purchase products on www.fooditalian.nl, the customer must agree to the General Terms and Conditions of Sale, which form an integral and substantial part of the purchase order. Such conditions have the value of a contractual proposal and do not bind Unibrands Italia S.r.l. to fulfilment, as each order is subject to acceptance.
At the time the order is submitted, the customer will receive an email containing all order details and the main information relating to the delivery of the products. They are required to print or save a copy of this communication and to inform Unibrands Italia S.r.l. immediately in the event of any errors.
The customer has the option to cancel, postpone, or request a change to the delivery address of the order within a maximum of 5 hours. Once this 5-hour period has elapsed, the order will be prepared for processing and it will no longer be possible to request cancellation or changes.
The customer may request an invoice by ticking the relevant box during the purchase process and entering the billing details, including: company name, full address, tax code and/or VAT number, and all legally required information. The invoice will be sent automatically immediately after the order is dispatched. The customer is fully responsible for the accuracy of the data entered and acknowledges that, if an invoice is not requested at the time of purchase, it will not be possible to request one from Unibrands Italia S.r.l. at a later date.
For all purchases on our platform, we accept the following payment methods:
The payment circuits we use employ high-security protocols. Credit card and prepaid card data, managed by our partner company Stripe, are protected by SSL (“Secure Socket Layer”) encrypted data transfer. For payments by bank transfer, the order will be processed once we have received confirmation of payment from our bank. It is very important to include the order number and the date on which the order was placed in the bank transfer reference.
Deliveries are made only to customers who are 18 years of age or over and are sent to the address indicated in the order. They are carried out by leading national and international couriers who are fully responsible for the delivery. Unibrands Italia S.r.l. cannot be held liable for any misconduct and/or any damage that couriers may cause to the customer, who is asked to report any such incidents to us.
In the event that the customer receives packages with evident damage, breakage or other non-conformity, the customer must return the package to the sender and immediately notify Unibrands Italia S.r.l. of the situation. In the event of accepting a damaged package, the customer undertakes to note on the courier’s document: “package accepted with reservation as damaged”. Unibrands Italia S.r.l. undertakes to replace the individual product if the customer documents the damage with photographs or other material of the product itself, all at no cost to the customer.
Delivery normally takes place on working days, within a period of three to ten working days from the date of order on our website www.fooditalian.nl. In the case of payment by bank transfer, the aforementioned period begins from the date of receipt of funds.
Pursuant to Legislative Decree no. 21 of 21 February 2014, the right of withdrawal applies to all purchases made on the Unibrands Italia S.r.l. website. The persons who may exercise it are those who, pursuant to the Consumer Code art. 3, paragraph 1, letter a), are defined as consumers.
The customer/consumer may withdraw from the contract within 14 days of receipt of the goods, without giving any reason, simply by sending an email to info@fooditalian.nl attaching the order. After receiving the email, the customer will receive authorisation to return the goods, which can be entrusted to a courier of their choice for return to the Unibrands Italia S.r.l. warehouses.
In order to carry out the return correctly, the following conditions must be met, failing which the right of withdrawal shall lapse:

Once the goods have been received, we will immediately process the refund request which, subject to verification that the above conditions have been met, will take place no later than 7 days after receipt of the goods. The customer is also entitled to a refund of the shipping costs paid at the time of purchase. The only costs to be borne are those for returning the purchased products as provided for in Article 67, paragraph 3 of the Consumer Code. The refund will be made exclusively in the name of the person who made the purchase using the same payment method (credit card/bank transfer) used to pay for the order.
For disputes, you may use the alternative dispute resolution platform set up by the European Commission, available at ec.europa.eu/consumers/odr.
Unibrands Italia S.r.l. reserves the right not to fulfil an order and shall not be liable for non-performance if caused by unforeseeable events or events that are reasonably beyond its control. These include catastrophic natural events, civil unrest, wars, power outages, terrorist acts, general strikes by public and/or private workers, and strikes and/or restrictions of courier and air services.
The security of customer data is a fundamental factor, and therefore Unibrands Italia S.r.l. implements protective measures that safeguard data against theft, loss, manipulation and falsification by third parties. Nevertheless, Unibrands Italia S.r.l. cannot guarantee to the customer that data may not be viewed or intercepted by unauthorised third parties.
The conformity guarantee to which the consumer is entitled is 24 months from delivery of the goods. In the event of a defect, this must be reported immediately to Unibrands Italia S.r.l. by email stating the order number, a detailed description of the defect found, and clear and complete photographs showing the problem.
The guarantee is not valid after the natural expiry date of the products and does not apply to products with a very short shelf life (15 days), for which the defect must be reported to Unibrands Italia S.r.l. within 3 days of receipt of the product. If Unibrands Italia S.r.l. ascertains the lack of conformity of the product, the customer has the right, upon return of the defective product, to obtain its replacement.
With regard to damage caused by product defects, the provisions of Italian Legislative Decree no. 206/2005 (Consumer Code) and European Directive 85/374/EEC apply. Unibrands Italia S.r.l., as online distributor, is exempt from any liability where the production facility is indicated on the label.
The customer declares to be aware that no part of this website may be reproduced, transmitted, stored, photocopied or recorded without the permission of the copyright holder. All trademarks, signs, photographs, videos, written texts, graphics and logos on the website belong to Unibrands Italia S.r.l. and/or their respective legitimate owners. The Fooditalian trademark and the Fooditalian.nl domain are licensed exclusively to Unibrands Italia S.r.l., which holds the rights for Italy.
The information on the website may be changed without prior notice. The photographs shown are for illustrative purposes only and may not correspond exactly to reality. The content of this site does not constitute a value and should not be considered as medical or nutritional advice.
